It does not take a genius to realize that we have some really crappy laws. I am not just talking about some of the stupid laws on the books like it being illegal to walk backwards down the street while eating a donut (true story). I am talking about laws that were implemented for very good reason and had significant consequence. Two come to mind quite easily. They touch on the same situation. Those are Affirmative Action and Title IX.
I know what it was supposed to correct and I am all in favor of it. But let us be totally honest about it. By creating quotas and giving favorable treatment to individuals for past wrongs there is an attempt to redress past wrongs. The problem is that you are creating current wrongs. You are discriminating against those negatively affected by Affirmative Action and Title IX. That is a fact. Trying to give excuses, trying to explain it away does not change that fact in any way. You are discriminating against someone to correct the discrimination of the past. I have news for you. The person being discriminated against may know the reason for it but it does not change the fact that they are being discriminated against. For their lifetime they suffer from discrimination. They only have this one life. The past may resonate with them but now is now. And now they are being discriminated.
As a side note: for those who do not understand why I lump Title IX as a discrimination issue, keep in mind that there is a ramification of the way it was implemented. I do not think it was the intent of the law but by lawsuit and complaint the implementation resulted in added sport programs for women as intended but resulted in removal of sports for men. In order to comply with Title IX they had to discriminate against men, often for the same sport as offered for women, simply to comply with the strictures of Title IX.
Discrimination is wrong and both Affirmative Action and Title IX are wrong, bad wrong. And how do we measure when it has been enough of a success, especially with Affirmative Action, that we can repeal the law and level the playing field. And when it is leveled who will complain and what will be the complaint. I wonder.
Having said that Affirmative Action and Title IX are crappy laws, I must confess I do not know of any better solution at the time. Sad.
